Les autorités québécoises ont annoncé hier qu'une enquête avait été ouverte sur quelque 125 entreprises et personnalités du secteur aurifère soupçonnées de fraude fiscale portant sur des transactions litigieuses évaluées à près de deux milliards de dollars. Les enquêteurs du ministère du Revenu ont effectué cette semaine plus de 70 perquisitions dans des entreprises, des bureaux de comptables et des syndics de faillite dans la région de Montréal, a indiqué le ministère dans un communiqué.

L'enquête vise les sociétés Kitco - un revendeur de métaux précieux - qui a des bureaux à Montréal, New York, Shanghai et Hong Kong - et la société Carmen International, ainsi que cinq individus, selon le ministère qui n'a pas nommé l'ensemble des personnes et individus soupçonnés. Les entreprises auraient détourné l'équivalent de 150 millions de dollars, l'équivalent de la taxe de vente provinciale de 8,5% non perçue sur des transactions litigieuses évaluées à 1,8 milliard de dollars canadiens.

Selon le stratagème, un fournisseur d'or vendait le précieux métal jaune, non taxable puisque considéré comme une monnaie à un transformateur qui en faisait des "rebuts" taxables. Le transformateur revendait les "rebuts" au fournisseur original en percevant des taxes qu'il ne déclarait pas au fisc. Le fournisseur original, lui, demandait au fisc un remboursement de taxes. Du coup, le gouvernement remboursait des taxes qu'il n'avait jamais perçues. Le fournisseur d'or affinait ensuite les "rebuts" d'or pour en refaire de l'or pur qui était finalement réintroduit dans le cycle pour faire gonfler encore la mise.

"Le stratagème repose sur des transactions artificielles. Il n'y a aucune véritable activité commerciale, le seul but de ces transactions étant de pouvoir demander des remboursements" de taxe, a expliqué le ministère québécois du Revenu. Aussi, "généralement un ou plusieurs intermédiaires sont ajoutés entre le fournisseur d'or et le transformateur d'or afin de complexifier la structure et de rendre la détection du stratagème plus difficile", ont fait valoir les autorités. Au Canada, le gouvernement fédéral impose une taxe sur les produits et service, à quoi s'ajoute la taxe provinciale dont le taux varie selon les provinces.

I have met Bart Kitner of Kitco note a number of times over the years. He is a lovely guy with a terrific smile. His main spokesman, Jon "The Nitwit" Nadler is one of the biggest jerks I have come across over the years.
The Nitwit spoke at the Vancouver conference a few days ago. Two young men came up to me following his presentation and told me how bearish he still is … that there are surpluses all over the place in gold and silver. They also made mention of how wrong he has been over the years. They went on to say they could not understand why Kitco employed someone who is always so negative about gold and silver prices. They understood that the Kitco mission was to sell gold and silver, not to have people shy away from the precious metals.
Well, they are right. None of us in the GATA camp could ever understand why Bart continued to employ The Nitwit, someone who makes a fool out of himself year after year.
You got me still. Could it be because soaring gold and silver prices has the potential to expose a fractional gold/silver program? … that Kitco cannot deliver all the gold and silver it has promised its customers? You got me, but I wish Bart well. The Nitwit ought to go.

Kitco shocked by raid after months of negotiations in gold tax scam

MONTREAL — A Montreal company that denies any wrongdoing in an alleged gold-refining tax scam said Friday it was shocked by an early-morning raid this week that came after several months of negotiations with Quebec's tax department.

Kitco Metals Inc. said it was negotiating with Revenu Quebec about its opposition to the tax assessment when agents raided its premises Tuesday.

"We were co-operating with them fully, so this definitely came as a surprise to us," Kitco spokeswoman Sharlene Dozois said in an interview Friday.

Revenu Quebec is probing sales of $1.8 billion by the network, with alleged provincial sales-tax evasion in excess of $150 million. The agency is also investigating evasion of the federal goods and services tax on the same sales.

Kitco asked Thursday for a court-appointed receiver that can supervise the 200-employee business while it addresses the allegations brought by Quebec's revenue department. RSM Richter has been appointed interim receiver.

The Montreal-based company, founded in 1977, says it is one of the largest retailers of precious metals in the world. It also provides specialized refining services.

More than 175 agents conducted raids on homes, offices, accountants and bankruptcy trustees in the Montreal area. The agency said the scam allegedly involved a system of repetitive and false billing in transactions involving more than 125 companies.

Most of the companies are jewelry stores, which have closed.

The department also said false tax returns were prepared for certain companies that provided the fake invoices.

Kitco said it "has never participated in any tax fraud, nor has it ever carried out any fictitious transactions."

"Kitco buys precious metals scrap and pays the suppliers sales taxes on these purchases for which Kitco receives a tax credit. It is the responsibility of these suppliers to pay back the sales taxes to Revenue Quebec."

Revenue Quebec alleges that Kitco and a company called Carmen Industries ran parallel operations.

Carmen Industries couldn't be reached for comment.

Published reports say Revenu Quebec placed liens worth $33.8 million each on two properties owned by company executives Steven and Joseph Chesir.

Nick Macri, vice-president of Carmen Jewelry, which shares the same phone number and operates in adjacent spaces in Montreal, said he hasn't seen the owners of the company in several months.

Although the two companies share similar names, Macri said they are unrelated although he did the accounting for Carmen International and remitted its taxes to government.

"We charged them a fee every month to give them a service and that's how we somehow got implied in this mess," Macri said.

It alleged that several people, including Viken Gebenlian, Haroutioun Dakessian, Oskan Hazarabedian, Benjamin Bensimon and Shadia Khatib created artificial tax declarations for certain companies involved by furnishing them with false invoices.

Those found guilty must pay the evaded funds plus interest, fines and a maximum of five years in prison.
